We've got a simple contract for your next party!!!
The first section of this page are our Terms and Conditions found on the backside of our contracts, unless you received a faxed contract. The second section answers and reviews common questions about the front side of our contracts. The last section reviews our Cancellation Policy.
TERMS AND CONDITIONS
1. PERFORMANCE OF SERVICES GENERALLY. SOUND CENTER DEEJAYS shall be prompt in appearing for the engagement(s) as required by CLIENT, shall perform services hereunder in a conscientious and artistic manner in accordance with the reasonable instructions of CLIENT.
2. INABILITY TO OF DEEJAY TO PERFORM. (a) It is agreed that should the DeeJay be prevented from performing, once at the site of the engagement, due to circumstances beyond his/her control (i.e. power failure, schedule conflicts with engagement site, strikes, acts of God or any other legitimate conditions beyond the control of SOUND CENTER DEEJAYS) the DeeJay shall not be held responsible and will be deemed to have fulfilled his/her obligation under this contract. (b) If DeeJay should fail to perform engagement described above for circumstances not beyond his/her control (as described by subparagraph (a)), this shall constitute a breach of contract and shall subject SOUND CENTER DEEJAYS to directs liability in damages to the CLIENT for the contract price of any missed engagement. This remedy shall constitute the limit of SOUND CENTER DEEJAYS' liability under any circumstances. (c) In the event the Deejay arrives late (per the specified contract time) for the engagement for any reason not excepted in subparagraph (a) of this section, at the CLIENT'S option SOUND CENTER DEEJAYS will either extend the time of performance by the length of delay or refund any part of lost hour(s) at the contract price.
3. CLIENTS LIABILITY. (a) The authorized agent asserts his authority to bind the organization and assumes liability both jointly and severely with the said Organization for terms and conditions stated herein. (b) The Organization hereby assumes responsibility for its customers, guests and staff and agrees to maintain conditions that will not inhibit the performance nor cause loss, injury or damage to the DeeJay or his/her equipment. (c) The Organization/Individual's failure or refusal to pay the above stated compensation to SOUND CENTER DEEJAYS, or to the individual DeeJay assigned to perform the contract, shall release SOUND CENTER DEEJAYS from furnishing any remaining services to the Organization under this contract. Refusal to perform under such circumstances shall not constitute breach of contract by SOUND CENTER DEEJAYS whether such unpaid claim shall be in whole or in part. (d) If the Organization/Individual breaches this contract it shall be liable for and pay to SOUND CENTER DEEJAYS the full contract price of the total engagement(s) plus five percent (5%) interest from date of breach. In the event that SOUND CENTER DEEJAYS shall institute any litigation against CLIENT due to the breach of this contract, CLIENT hereby agrees to pay in addition to his obligation set forth above, all costs of such litigation and an attorney's fee of twenty-five percent (25%) of the amount set for, but not less than $300. No waiver of any breach of any condition of this agreement shall be construed to be a waiver of any subsequent breach of this agreement
4. GOVERNING LAW. This agreement shall be governed in accordance with the laws of the Commonwealth of Virginia. If any provision of this contract is held to be invalid under the law, the other provisions will continue in full force.
THE ORGANIZATION/INDIVIDUAL WILL BE RESPONSIBLE TO PROVIDE, AT THE SITE OF THE ENGAGEMENT AT LEAST TWO TABLES (APPROX. 6 FEET IN LENGTH AND TWO FEET IN WIDTH) FOR DEEJAY'S EQUIPMENT PLUS 1 A.C. POWER OUTLET (3-PIN TYPE PREFERRED) TO BE PLACED WITHIN REASONABLE ACCESS OF THE PLAYING SITE (50 FEET OR LESS UNLESS PREVIOUSLY ARRANGED.
THE FRONT OF THE CONTRACT
The front of the Sound Center Contract is self-explanatory, but here are a few items to double check before signing. If there are any mistakes or mispellings, simply correct and initial them. If the date, times and/or location has changed, contact our Customer Service Department to make sure that the changes are entered into our database scheduling system.
REVIEW THESE ITEMS ON YOUR CONTRACT:
PLACE OF PERFORMANCE: The location of the party is listed here.
DATE OF PERFORMANCE: The date of the party is listed here.
HOURS OF EMPLOYMENT: Actual "playing" time is listed here. Generally the start of the party should be when the guest are allowed into the room. The end of the party could go beyond the listed "end time", but then the hourly "overtime" rate would apply.
GENERAL NATURE OF EVENT: Basically, the type of function is listed here.
GENERAL NATURE OF MUSIC: Typically, "variety" is listed here, unless a certain theme type of function. Also, your scheduled DJ is listed here and/or if you are having just a DJ, or Karaoke (Sing Outta Tune Karaoke) or a DJ/Karaoke combo.
GROSS WAGES OR COMPENSATION: This is the price for the times, date, location and type of function you are having.
DEPOSIT REQUIRED... This is the amount of deposit that is required with a signed contract. Deposits are not refundable.
OVERTIME RATE PER HOUR: The overtime rate starts after the contracted actual time has been passed. (If your party was scheduled from 7:00 pm to 11:00 pm, to go till 12:00 am, the one hour overtime rate would apply. ) The contracted time is not the amount of hours listed on the contract UP TO xxx HOURS assuming the DJ was ready to play at 7:00, but you and your guest extended the cocktail hour and came into the room at 8:00, the contract times would still be till 11:00 pm, not four (4) hours from when you and your guest come into the room. NOTE the terms and conditions section 2, subparagraph (c).
DATE CONTRACT IS TO BE RETURNED: Look for the following line 3/4 the way down the contract for the return date.

WHERE TO SIGN: On the bottom left, there will be two lines. On the top line, print individuals and (if applicable) company name. The second line is for the actual signature. To the right of these two lines, the signature of an authorized representative of Sound Center DJs will be signed prior to you receiving the contract.
CANCELLATION OF CONTRACT POLICY
All deposits are non-refundable. You have up to thirty (30) days prior to the contracted date to cancel your contract with Sound Center DJs without being held to the remainder of the balance on the contract. Cancellations must be in writing and accompanied with a copy of the original contract.
Keep in mind that once a DJ is booked, we turn down business for that DJ on that specific day. Since most functions are booked three months or more in advance, if an event is cancelled, more than likely our DJ will not be rebooked for that day and consequently loses pay. Holding one to a contract , if cancelled less than thirty days prior to the event, allows us to retain the best professional DJs in the area.
Although the deposits are non-refundable, we can apply the deposit to another function within one (1) year period of the original event date. Pricing may be different than the original, but the deposit amount will remain the same. Contact our Customer Service Department if you have more questions concerning our Cancellation Policy.
